By registering an account, purchasing a product, booking a class, or subscribing to any plan, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must not use our services.

EllenElleFit is an online Zumba dance fitness platform operated in Nigeria. We provide livestreamed classes, on-demand workout videos, digital instructor certification courses, and downloadable fitness plans for individuals and fitness professionals. Our services are delivered entirely in digital format via the internet.

2.  Eligibility

To use our services you must:

  • Be at least 18 years old, or have verifiable parental or guardian consent if you are between 13 and 17 years of age.
  • Have the legal capacity to enter into a binding contract under Nigerian law.
  • Provide accurate, current, and complete information during registration and checkout.

We reserve the right to refuse, suspend, or terminate access for any user who does not meet these requirements or who provides false information.

 

3.  Account Registration

3.1  Creating an Account

Some services require you to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us immediately at info@ellenellefit.com if you suspect unauthorised access.

3.2  Account Information

You agree to keep your account information (including email address and phone number) accurate and up to date. We use this information to deliver your purchase confirmation, access links, and digital downloads.

3.3  One Account Per Person

Accounts are personal and non-transferable. You may not share your login credentials or allow third parties to access paid content using your account.

 

4.  Products and Services

EllenElleFit offers the following categories of digital products and services:

  • Monthly and Annual Subscription Plans – unlimited access to live classes and on-demand video libraries for the subscription period.
  • Drop-In Live Class Bookings – single-session bookings for instructor-led Zumba sessions conducted via video conferencing.
  • On-Demand Video Bundles – curated collections of pre-recorded workout videos available for streaming and download.
  • Digital Instructor Certification Courses – self-paced courses leading to an EllenElleFit digital certificate of completion.
  • Downloadable Fitness Plans – PDF-based structured programmes covering workout schedules, nutrition guidance, and tracking tools.

All products are digital in nature. No physical goods are shipped..

 

5.  Pricing and Payment

5.1  Pricing

All prices are displayed in US Dollar unless otherwise stated. Prices are inclusive of any applicable taxes. We reserve the right to change our prices at any time; however, changes will not affect orders already confirmed.

5.2  Payment Methods

We accept payment via debit and credit card. Payment must be completed in full before access is granted to any product or service.

5.3  Subscription Billing

Monthly subscriptions are billed on the same date each month from the date of first purchase. Annual subscriptions are billed once per year. You authorise us (or our payment processor) to charge your selected payment method on each renewal date. You will receive a reminder notice at least 7 days before each renewal.

5.4  Failed Payments

If a payment fails, access to subscription benefits will be suspended until payment is successfully processed. We will attempt to notify you via the email address registered to your account.

 

6.  Cancellation and Refund Policy

6.1  Subscriptions

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period; you will retain access until that date. We do not provide pro-rata refunds for unused portions of a subscription period.

6.2  Live Class Bookings

Bookings may be cancelled or rescheduled up to 24 hours before the scheduled session start time for a full credit to your account wallet. Cancellations made within 24 hours of a session are non-refundable. If EllenElleFit cancels or reschedules a session, you will receive a full credit or refund at your election.

6.3  On-Demand Videos and Downloadable Plans

Because digital content is made available immediately upon purchase and can be accessed or downloaded at once, all sales of on-demand videos and downloadable fitness plans are final and non-refundable once the content has been accessed or downloaded.

6.4  Certification Courses

Certification course purchases are non-refundable once any course module has been accessed. If you have not accessed any module within 7 days of purchase, you may request a full refund by contacting us at info@ellenellefit.com.

6.5  Exceptional Circumstances

We will consider refund requests made in exceptional circumstances (e.g., verified medical emergencies) on a case-by-case basis at our sole discretion.

 

7.  Intellectual Property

7.1  Our Content

All content on the EllenElleFit platform – including but not limited to videos, course materials, fitness plans, graphics, logos, choreography, music curation, written materials, and software – is the exclusive intellectual property of EllenElleFit or is licensed to us by third parties. All rights are reserved.

7.2  Permitted Use

Your purchase grants you a limited, personal, non-exclusive, non-transferable licence to access and use the purchased content for your own private, non-commercial fitness purposes. This licence does not permit you to:

  • Copy, reproduce, distribute, broadcast, or publicly perform any content.
  • Share your account credentials or purchased content with third parties.
  • Use any content for commercial purposes, including teaching paid classes based on our choreography without a valid EllenElleFit instructor licence.
  • Reverse engineer, decompile, or otherwise attempt to extract source code from any platform software.

7.3  Instructor Certification Holders

Upon completing and passing an EllenElleFit certification course, you are granted a limited commercial licence to teach Zumba classes using the techniques and frameworks taught in the course. This licence is personal to you, is valid for the period stated in your certificate, and does not transfer ownership of any EllenElleFit intellectual property to you.

 

8.  User Conduct

You agree not to:

  • Post, upload, or transmit any content that is abusive, hateful, defamatory, obscene, or otherwise harmful.
  • Impersonate any instructor, staff member, or other user.
  • Interfere with, disrupt, or attempt to gain unauthorised access to any part of our platform or systems.
  • Use automated tools (bots, scrapers, crawlers) to access or collect data from our platform.
  • Engage in any conduct that violates applicable Nigerian law or international law.

We reserve the right to suspend or permanently ban any account found to be in breach of this section without prior notice and without refund.

 

9.  Health and Safety Disclaimer

Our classes and fitness plans are designed for general wellness purposes. You acknowledge that:

  • Zumba and dance fitness activities carry an inherent risk of physical injury.
  • You are responsible for consulting a qualified medical professional before beginning any new exercise programme, particularly if you have a pre-existing medical condition, are pregnant or postpartum, or have been physically inactive.
  • You participate in all classes and follow all fitness plans entirely at your own risk.
  • EllenElleFit, its instructors, and its staff are not medical professionals and nothing on our platform constitutes medical advice.

Our Postnatal Zumba Recovery Plan and similar specialist plans are reviewed for general safety but are not a substitute for medical guidance from your healthcare provider.

 

10.  Live Class Conduct

When attending a live class via video conferencing:

  • You must maintain a respectful environment and follow instructor instructions at all times.
  • Recording, screenshotting, or re-streaming any live session without express written permission from EllenElleFit is strictly prohibited.
  • You consent to your video feed being visible to the instructor and other participants in open-camera sessions.
  • EllenElleFit reserves the right to remove any participant from a session for misconduct without refund.

 

11.  On-Demand Video Access and Replay

Replay access for live sessions is available for 48 hours following the conclusion of the session. On-demand video content remains accessible for the duration of your active subscription or, for one-time purchases, for the lifetime of the product (subject to Section 14 on service changes). We do not guarantee uninterrupted access due to scheduled maintenance or technical issues beyond our control.

 

12.  Privacy and Data

Your use of our platform is also governed by our Privacy Policy, available at www.ellenellefit.com/privacy. By using our services, you consent to the collection and use of your personal data as described in that policy. We are committed to protecting your data in accordance with the Nigeria Data Protection Act (NDPA) 2023 and the Nigeria Data Protection Regulation (NDPR).

 

13.  Third-Party Services

Our platform may integrate with or link to third-party services including payment processors, video conferencing providers (Zoom), and messaging platforms (WhatsApp). Your use of those services is governed by their respective terms and policies. EllenElleFit is not responsible for the practices of any third-party service provider.

 

14.  Changes to Services

We reserve the right to modify, suspend, or discontinue any product, feature, or service at any time. Where a discontinuation materially affects an unexpired purchase, we will provide at least 30 days’ notice and offer a pro-rata credit or refund as appropriate. We also reserve the right to update these Terms at any time. The updated Terms will be posted on our website with a revised effective date. Continued use of our services after the effective date of any changes constitutes your acceptance of the revised Terms.

 

15.  Limitation of Liability

To the maximum extent permitted by applicable law:

  • EllenElleFit, its directors, employees, instructors, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.
  • Our total aggregate liability to you for any claim arising out of or relating to these Terms or our services shall not exceed the amount you paid to us in the 3 months immediately preceding the event giving rise to the claim.
  • We do not exclude liability for death or personal injury caused by our gross negligence, fraud, or any other liability that cannot be excluded by law.

 

16.  Indemnification

You agree to indemnify, defend, and hold harmless EllenElleFit and its officers, directors, employees, and instructors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of our services; (b) your violation of these Terms; or (c) your violation of any applicable law or the rights of any third party.

 

17.  Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any dispute arising out of or in connection with these Terms shall first be referred to mediation. If mediation fails to resolve the dispute within 30 days of the referral, the parties shall submit to the exclusive jurisdiction of the courts of Oyo State, Nigeria.

 

18.  Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

 

19.  Entire Agreement

These Terms, together with our Privacy Policy and any other policies or notices published on our website, constitute the entire agreement between you and EllenElleFit with respect to your use of our services and supersede all prior agreements, representations, and understandings.
